Let's remember something here - "drug paraphernalia" can mean a lot of things, but most importantly it means, "no drugs". If the players involved had been caught with actual drugs, then there would have been a drug charge ("possession of controlled substances") as well.
Many items (too many, IMHO) can be considered "drug paraphernalia" under the law, including plastic bags, tea spoons, and corn cob pipes ... and just about anything else that a cop with a chip on his shoulder thinks could be even remotely associated with drug use. Stupid laws lead to stupid charges, and this looks like a perfect example of that. As BKB said, this incident happened six weeks ago, and we hadn't heard a peep about it until Friday night. If this were a big deal, then I'm sure that the info would have hit the internet much sooner than that. |

I posted this over on the GBW free site because JB and Mike are now the equivalent of Tony Montana so I felt the need to clarify something:
I am a former middle school science teacher. I used triple beam balance scales in my classroom all the time. I also would take them home from time to time to do routine cleaning, maintenance, etc. One day I'm on my way home from school and I get pulled over for going 42 in a 35 mph zone. I also have two scales in my back seat. Police officer calls for back up and I sit there for an hour and a half while they try to decide what to charge me with. Guy is convinced I'm a dealer. I tell him "there are 20 other scales just like this back in my store room at school if you don't believe my story." I ended up not even getting a speeding ticket which is what he pulled me over for in the first place. Nobody appreciates how difficult a cops job is more than me, but if a cop is having a bad day he can make life very difficult for you. Not saying that's what happened here, but the point is we really don't know what happened here. |

I'm confused. They had drug paraphernalia in the car, yet they would pass a marijuana test???
Not that I really care. I knew maybe one or two guys in college that DIDN'T smoke pot once in a while. It's the offseason. They're young. They shouldn't do it. If it happens again, then suspend 'em. |

Just because there was a piece of paraphernalia in the car doesn't mean it belonged to one of them. I'm sure at some point there was someone besides those two riding in the car, and if they had a small pipe in their pocket that fell out and got lost in the seat cushions, there's your drug charge. I had a friend who was charged with possession after a cop found a cellophane cigarette wrapper filled with weed under his passenger seat. The day of his hearing, he took the initiative to talk to the prosecutor before his case was called up, and told him it wasn't his, and he had no idea it was there. The charge was dropped.
