Fostoria man convicted in OSU ticket scam
Friday, September 29, 2006
ASSOCIATED PRESS
A jury convicted a Fostoria, Ohio, man yesterday of theft and fraud for failing to deliver Ohio State-Michigan football tickets that he sold in an online auction.
Mark West, 54, testified in Bowling Green that he priced the tickets too low and did not have enough money to buy tickets to fulfill his orders.
West had pleaded not guilty to the charges and could be sentenced to six to 18 months in prison and fined $5,000 on each charge. Sentencing was set for Dec. 1 in Wood County Common Pleas Court.
West, the only witness called by the defense, said what he was doing was allowed on the online auction site eBay Inc. as long as the seller acknowledges a specific date when the tickets will be available. "It?s what they call a pre-sale," West said.
West said he couldn?t deliver tickets to about 250 of the 400 customers who bought tickets. In many cases, buyers paid up to $300 or more per ticket to the game. At least 200 people filed complaints against him, and eBay reported customer losses of $260,000.

Seems like fuzzy math to me. If 250 people lost out on $300 each, that's $75,000.
How were losses of $260,000 accumulated in this case? That's over a grand per ticket.
Regardless, glad the bastard is being put away.

Is that a $5,000 fine on each of the 200+ complaints? Or does it all roll up into one jelly-filled charge?

Where excactly is Fostoria?

My great great uncle Clifford Heffelfinger (#45) played at OSU in 1939. And my cousin Evan Jablonka (#84) plays right now. Anyway, I read if you're related to somebody who has played at Ohio State, they will put you on their practice squad. But that doesn't mean you'll dress for the games though. When I go to Ohio State to major in Sports Journalism, this is what I am going to do. I won't stop there, because I will try to dress and make the team.

Sounds like the charges are "theft & fraud" (not sure how many degrees of each are being 'charged') and the fines will be based per charge, not per complaint.

On Route 23 near Findlay (which is 12 miles to the west). It is 100-110 from C-Bus.
