If I understand you correctly, you are saying they don't deserve to be in the top 12. I agree.

Texas drops in rank after struggling with Colorado, tOSU drops in rank after struggling with Navy, does BSU drop after struggling with Tulsa?

If TCU wins out, they'll pass Boise St. in the polls and claim the 1 automatic berth that goes to the highest non-AQ-BCS-Conf team in the top-12 (or top-16 if they're still above any BCS Champ). If they both finish in the top-12, only 1 spot in guaranteed.
But if TCU loses, Boise State will probably go undefeated and claim that automatic bid, since voters won't move them down as far as they should. Their preseason ranking was annoying, since TCU beat them in a bowl last year. It was only so high because of their chance of going undefeated against the easy schedule, combined with the voters' dim memory (or dim voters' memory) of the finish to that Fiesta Bowl against Oklahoma. |

When you scrape together a win against a Tulsa team that Oklahoma beat 45-0, and Idaho is a better team than Tulsa that represents a threat waiting on your doorstep, you don't belong in the top 20.
