Although McNair was just a passenger, he was charged with a misdemeanor under a Tennessee law that prohibits a vehicle owner from letting it be driven by someone who is inebriated.

So was the driver arrested for DUI too?

And if the driver wasnt drunk, then why can't the passenger be drunk. Thats just like getting a designated driver like everyone tells you to get when your drunk.

It doesn't matter if the driver was drunk...the driver blew over the limit and is therefore arrested on the spot. Tennessee law then charges McNair with an offense because it was his car used in the implication and he let it happen (since he was in the car).

I live in Baltimore and since I've moved, I've tried to become a bigger Ravens fan (sorry Brownies, I never liked them in the first place). That being said, McNair is guilty by law for letting this happen in his vehicle.

Seeing how it is explained, I don't really have that much of a problem with it. I think that if you let someone drive your car while they are drunk, it's basically contributing to drunk driving. I wouldn't put it at the same level as an actual DUI, but I can see the logic behind it.

I'm not sure I agree with that. Sure it's strict, but you need to have enough sense and responsability to know that your driver is indeed a DD and not drinking more than 1-2 beverages.

Based upon my experiences trying to dodge the drunk drivers from the arena district back to campus (back when I was in college), I'm glad to see tougher laws, and have no problem with this so-called "guilt by association". Take responsability for someone driving your car.

It's not a stupid law at all. It's 1 more way to prevent people from driving drunk. If anything this is good for the general population, because McNair will bring attention to this law. I bet it saves at least one life.

agreed...and it wasn't like McNair let him borrow the car and then wasn't with him. Mcnair was in the car to, so he knew that the guy had been drinking.

It's all about accountability guys. Athletes and Hollywood are notorious for lacking accountability. If you cant take responsability of who is driving your car then you don't deserve the right to own a car.

It's not so much just this law, but this law together with .08 being legally drunk that I have a problem with. If your DD weighs what, 175 lbs and has two beers in an hour they are drunk. So I go out for an hour, have four, maybe five tall ones, and the guy who nurses two bottles is in no condition to drive? Bull[censored].

Ok, I agree 0.08 is a little ridiculous. I think 0.12 is a little more fair personally.
