Cleveland -- Browns receiver Donte Stallworth has issued his first public comments since a car he was driving reportedly struck and killed a pedestrian on a Miami Beach causeway last Saturday.

Through the Browns, Stallworth said, "My family and I are grief-stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life.

"My thoughts and prayers are with the Reyes family during this incredibly difficult time. Unfortunately, since this accident is still under police investigation, I cannot comment further on the matter at this time."

Miami Beach police officials are waiting for toxicology tests on Stallworth's blood, due on Friday, before deciding whether to press charges against Stallworth.

I sure hope his blood tests come back clean or he will look more like of a jackass

A television station in Miami reportedly is reporting that Brown receiver Donte? Stallworth was ?slightly? over the legal limit of 0.08 percent blood-alcohol concentration when his vehicle collided with Mario Reyes, a pedestrian who died as a result of the Saturday morning collision.

CBS4 in Miami reports that the report, which was made at noon by a local television station that CBS4 didn?t identify, could not be confirmed by Miami Beach police or by Stallworth?s lawyer.

If the report is accurate, Stallworth is in serious legal jeopardy. In Florida, DUI manslaughter carries a maximum sentence of 15 years.

In contrast, Leonard Little served only 90 days a decade ago after killing Susan Gutweiler while Little drove drunk.

Regardless of the manner in which the potential criminal proceedings unfold, Stallworth also faces enormous civil liability. The fact that he earned a $4.875 million roster bonus the day before the incident could make $4.875 million the bottom-line demand for the eventual settlement discussions.

Then again, Stallworth might never get that $4.875 million from the Browns, depending on the language of his contract and the manner in which it would be interpreted by an arbitrator.

I just cannot comprehend the need for him to knowingly go out and party, and take his car. He doesn't have any friends to drive? He didn't want to rent a limo? Is he above a taxi? Is it, that he ismply wanted to flash his ride at the club? Doesn't trust someone else to drive his whip?

That is the frustrating part to me. Hell, I'm ecstatic when I'm going out for a few, and I don't have to drive. Why these guys do it when they can afford a limo or taxi or just have a friend go DD is ridiculous to me.

In his defense, at .08 you don't feel drunk. Especially if it was the morning after. You party.. you crash.. you wake up & drive.

With that said, I do agree with taking a taxi or cacthing a ride.

It's the pre-planning to me Bleed S&G. He just earned a [censored]load of money, knee ahead of time he was going to get crunk. Celebration time. Good for him.

Why the hell put yourself in that position. I'm honestly trying to think through the process, and the only thing I can think of, is he wanted to flash his ride while club hopping. Keep in mind, if what he says his true, and I'm sure it's a very loose descripton of what happened, but he was drinking heavily in the early evening until 12. He was apparently driving to his condo at 7. My guess is he was driving plastered all night spot to spot, until the fatal accident at 7.

Again, why not treat a friend to a wild night while he chauefers you around. Or just rent a limo for the night.

I don't feel like I'm talking from a soapbox right now, it just seems like common sense. He has way too much to lose by pullingthe stunt he did.

And condolences to the Reyes family, which I'm sure would trade the millions they are about to win for their husband, father, etc. And that is speculation on my part, as I have no idea if he has family, but you'd have to think there are some people wondering my a loved one was killed so needlesly.

ESPN's bottom line just said he was at .12 (I think). I'm not exactly sure when you start feeling drunk, but I bet .12 is about that point..

Physiologically you are impaired at .05. Not saying drunk, but studies have show that is were the stats show that the impairment curve starts. No way to avoid the reality that at .12 you are intoxicated.

Even if you did nothing wrong, the burdon you face being at .12 is a real problem, because you can never say that your decision making and response times were not affected by your drinking. Stupid, needless waste.
