Ex-NCAA leader criticizes investigation into 'Bama

BIRMINGHAM, Ala. (AP) -- A former NCAA leader who chaired the committee that imposed stiff penalties on Alabama's football program is now criticizing the way the sanctioning organization handled its investigation of the Crimson Tide.

David Swank, a former chairman of the NCAA's Committee on Infractions, said in court documents that the panel should not have considered information from a confidential witness who was involved in revealing wrongdoing by the program.

Swank also said the committee misclassified some violations it said were committee by former Alabama booster Ray Keller and went to far in labeling Keller and two other boosters as "rogues" and "parasites" on the program, The Birmingham News reported Friday.

A judge previously ruled that Swank, a former vice president of the NCAA, could provide written testimony for Keller, a Jackson County businessman suing the NCAA for defamation. Keller claims the NCAA libeled him during the 2002 investigation that resulted in probation for the Tide.

According to documents filed by the defense, Swank is most critical of the NCAA for allowing the testimony of Tom Culpepper, an analyst who provided information linking boosters to a recruiting scandal that led to five years of probation and scholarship losses for Alabama.
Robert Rutherford, an attorney for the NCAA, denied Swank's claims.

"We certainly don't believe the rules of using a confidential witness were violated in this case -- especially since the University of Alabama knew the identity of the confidential witness and interviewed him," he said.

Keller's attorney, Archie Lamb, said the NCAA wants to bar Swank from appearing "because they're scared of him.

"David Swank is the pre-eminent expert in the country and the architect of NCAA enforcement bylaws. No wonder they're afraid of his testimony."

Before serving as the chairman of the NCAA's Committee on Infractions for a decade, Swank served as an interim president and law dean at the University of Oklahoma.

The State of Alabama's Supreme Court is hearing a suit claiming that the NCAA should have to pay the $30 million legal judgment assessed to Tom Culpepper, who was a witness in the NCAA's case against Alabama that was sued for defamation by former 'Bama Ronnie Cottrell. The $30 million verdict has been overturned by a Circuit Court judge, who ordered a new trial.

TUSCALOOSA, Ala. (AP) -- An attorney for the NCAA told the state Supreme Court on Tuesday there was an indemnity agreement with a recruiting analyst stemming from a probe of Alabama's football program, but he said it would not require the NCAA to pay a $30 million jury verdict that was overturned by the trial judge.

An attorney for Ronnie Cottrell, a former Alabama assistant who sued the NCAA and analyst Tom Culpepper for defamation in the probe, argued that the agreement makes the NCAA liable for any judgment against Culpepper in the suit.

So, the $30 Million suit got thrown out - what about another suit, another "defamed" party.

Jury Awards $5 Million in Alabama Booster lawsuit.

A jury awarded $5 million Thursday to a former University of Alabama football booster who claimed the NCAA defamed him when it imposed penalties on the Crimson Tide in 2002.The state court jury awarded Ray Keller $3 million in punitive damages, $1 million for mental anguish, $500,000 for economic loss and $500,000 for damage to reputation.
Keller, a timber dealer and fan the university severed ties with because of the probe, argued that the NCAA slandered and libeled him during the announcement of penalties by referring to him and others as "rogue boosters," "parasites" and "pariahs."
After the verdict, Keller hugged his lawyers, friends and family. He said beating the NCAA in court was like "taking on a giant" and winning.
"I didn't ever feel we were as big as David going with Goliath going up against them," he said.
The jury of nine women and three men deliberated less than six hours over two days to reach the verdict. Jurors declined comment afterward.
NCAA spokesman Chuck Wynn said the organization will ask the judge to set aside the verdict.
"If not," he added, "we'll appeal to the Alabama Supreme Court."

Cottrell and Williams were two Bama coaches that lost their jobs during the big scandal a few years back, then sued and won a $30 million judgment, which was subsequently thrown out by the Alabama Supreme Court.

They appealed that ruling to the U.S. Supreme Court, which has now turned down their appeal without comment. They are entitled to a new trial in Alabama, but it would be more difficult after the state court's previous ruling.

Ray Keller - it's how you say "No Respect"

Logan Young's $5 Million award in a slander suit against the NCAA has, predictably, been tossed on appeal.

BIRMINGHAM, Ala. -- A judge threw out the $5 million verdict an Alabama football fan won in his lawsuit accusing the NCAA of slander, ruling in a decision made public Wednesday that jurors were swayed by prejudice.
Circuit Judge William Gordon granted the NCAA's request for a new trial in a lawsuit filed by timber dealer Ray Keller. He did not set a date.
Keller claimed the NCAA slandered and libeled him when it announced penalties against Alabama in 2002 by referring to him and others as "rogue boosters," "parasites" and "pariahs."
The NCAA said it never publicly identified Keller, and it portrayed him as a rabid fan who lost all perspective on the game.

NCAA gave former recruiting analyst $150K in Alabama case


TUSCALOOSA, Ala. (AP) -- The NCAA has paid $150,000 to settle with a key witness in its last case against the Alabama football program.

The Birmingham News reported Wednesday that recruiting analyst Tom Culpepper received $150,000 in May. He was a secret witness in the NCAA's investigation into Alabama football recruiting.

The NCAA had signed a confidential agreement with Culpepper to pay his legal fees and protect him from any possible court judgments. Under the agreement, Culpepper had to release the NCAA from any claims against the organization.

Culpepper gave a deposition in July as part of his divorce proceedings saying that the NCAA paid his attorney's fees and expenses related to litigation stemming from the NCAA investigation, in addition to the money he received in May.
