Everyone knows you NEVER BRING A LOADED GUN TO AN AIRPORT ... everyone, except Dwight Howard apparently.

TMZ Sports has learned the NBA superstar was stopped at George Bush Airport in Houston on August 28th ... when Dwight put his carry-on bag through the scanner, and a TSA agent noticed a LOADED GLOCK inside!!!

Law enforcement sources tell us ... a further inspection revealed the gun -- a Glock 26 9mm -- was LOADED with one round in the chamber.

We're told Dwight said he simply forgot the gun was in the bag.

But multiple law enforcement sources tell us ... because it's Texas -- and they have looser gun laws than states like California -- Dwight was NOT ARRESTED.

Cops were called to the scene, but we're told he was allowed to give the weapon to an associate who took the gun out of the airport.

As for Dwight, once he was disarmed -- he was allowed to get back in the security line ... and boarded his plane as if nothing ever happened!

The Houston Police Department tells us ... the District Attorney was aware of the case, but ultimately decided NOT to prosecute Howard.

While the district attorney was called, no charges were pressed. This is not uncommon; few charges are filed in incidents where guns are found in security screenings in Houston, according to police.

Howard was fortunate not to do this in California or New York, where the laws are more restrictive. He has not yet commented on the incident.

It is a federal crime to attempt to board a commercial aircraft with a loaded gun, even if that gun is in your checked baggage. I'm not sure what local gun laws have to do with it.

USC Sec. 46505
(a) Definition.— In this section, “loaded firearm” means a starter gun or a weapon designed or converted to expel a projectile through an explosive, that has a cartridge, a detonator, or powder in the chamber, magazine, cylinder, or clip.

(b) General Criminal Penalty.— An individual shall be fined under title 18, imprisoned for not more than 10 years, or both, if the individual—

(1) when on, or attempting to get on, an aircraft in, or intended for operation in, air transportation or intrastate air transportation, has on or about the individual or the property of the individual a concealed dangerous weapon that is or would be accessible to the individual in flight;

(2) has placed, attempted to place, or attempted to have placed a loaded firearm on that aircraft in property not accessible to passengers in flight; or

(b)(1): Carry-on baggage: cannot have any "dangerous weapon", which includes a firearm
(b)(2): Checked baggage: cannot have loaded firearm

I agree with you. "Federal law" over rides "state law" and should be enforced. However, apparently like San Francisco is a "sanctuary city" for illegal aliens, Houston is a de facto "sanctuary city" for carrying illegal firearms.

Question for the lawyers: Crossing a security checkpoint, which normally occurs when you attempt to enter the terminal, is not the same as boarding the aircraft, right? I mean, that law reads you cannot take a firearm on an aircraft. It does not read you cannot take a firearm into an airport. Maybe there is a different law or further ruling that elaborates on this?

I went back to the DFW incident with Barry Switzer in 1997 and see he was arrested and charged for carrying a revolver in his carry-on, but his arrest was because he did not possess a concealed carry permit. There was even the recent event in Atlanta where an open-carry activist took an AR-15 into Hartsfield-Jackson.

It all depends on the definition of "attempted" and how it applies to the facts of the particular case.

Talk about a prolonged fall from grace. Go back to c2009/10, he was the centerpiece of a strong Orlando team that made one Finals, and just missed another. He's THE dominant big man in the league and looked at by many as the heir apparent to Shaq. He was a physical marvel, had an engaging personality, and a big smile. All is peachy. Fast forward a couple of years, and some chinks in the armor begin to appear. He holds Orlando hostage, essentially forcing a trade to Tinsel Town. Unfortunately for Dwight, by that point, the Lakers dynasty is crumbling as Kobe is aging, and Phil walks away from the game (again). He spends a nondescript season in a Lakers uniform amidst accusations that he's not giving acceptable effort, and is a selfish player. He still cashes in and signs a big contract with Houston, pairing him with another dynamic scoring wing player in James Harden. Unfortunately again, his body begins to betray him, and he's still plagued by questions about his effort.

That brings us to today, where the Rockets are desperately searching for any suitor to take him off their hands, and apparently receiving zero interest. Good. Fuck Dwight Howard.

Saw a report that Harden and Howard were basically trying to get the Rockets to trade the other :lol:
