Ohio State University owes fired basketball coach Jim O'Brien nearly $2.5 million, an appeals court ruled yesterday.
The Franklin County Court of Appeals, in a 2-1 ruling, upheld an Ohio Court of Claims decision that O'Brien should get nearly three years of salary. Judges Gary Tyack and Donna Bowman ruled in O'Brien's favor; Judge Judith L. French dissented.
The appeals court, though, rejected O'Brien's counter-appeal, which argued that he was entitled to an additional $1.3 million, the equivalent of two more years worth of pay.

A roster of Ohio State University's traditional athletic rivals has joined the university in urging the Ohio Supreme Court to throw out a $2.5 million award to fired basketball coach Jim O'Brien.
The University of Michigan, the University of Minnesota and 21 more universities and athletic conferences filed a friend-of-the-court brief this week asking the state's highest court to overturn an appeals-court ruling in O'Brien's favor.

Former Ohio State coach Jim O'Brien has become a viable candidate to return to a sideline after Thursday's announcement that his show-cause penalty was dropped by the NCAA.

The NCAA appeals committee granted O'Brien the opportunity to resume his career, revoking the NCAA infraction committee's show-cause penalty that was set to expire in May 2009. It was originally set to expire in March 2011, but was reduced by the NCAA last May.

A show-cause penalty doesn't prevent a school from hiring a coach but it means that if it does, the school must then appear in front of the committee on infractions and see if further sanctions should be imposed on their new hire.

Jim O'Brien, fired by Ohio State and essentially banned from coaching by the NCAA for paying a recruit, can return to the college sidelines after an appeal changed his punishment.
An NCAA ruling on March 10, 2006, all but prevented any colleges from hiring O'Brien until May 2009.
But in a decision released Thursday, an appeals committee changed the start date of the sanctions against the coach, making him free to return to coaching effective March 10.
''I am pleased that my 31/2-year battle with the NCAA has finally come to an end and resulted in victory,'' O'Brien said in a release issued through his Columbus attorneys. ''I have felt all along that the penalty imposed upon me by the (NCAA's) Committee on Infractions was both excessive and unjust. . . . If I choose to coach again, I can do so without restriction.''
O'Brien has dabbled in broadcasting since his dismissal.

State Supreme Court upholds big award to O'Brien

The Ohio Supreme Court has upheld a $2.46 million award to Jim O?Brien, the former Ohio State University basketball coach.

In a 5-2 ruling, justices declined to accept an appeal of lower court rulings filed by the university. The dissenting votes came from Justices Evelyn Lundberg Stratton and Judith Lanzinger.

COLUMBUS ? During his 22 years as a college head coach, friends, players and adversaries always remarked about how dedicated Jim O'Brien was to the game of basketball. Now he's not so sure.
"Coaching has been what I've done; it's been a major part of my life ? and it was kind of snatched away from me," he said Wednesday, Feb. 20. "I'm still trying to put all the pieces together and I'm trying to really get a good grasp of what it is that I want to do. It's hard to all of a sudden say you have no interest in college basketball."


The Ohio Supreme Court on Wednesday declined to hear Ohio State's appeal of a lawsuit O'Brien filed against the university after he was fired in the wake of his revelation that he had given $6,000 to a recruit. Ohio State lost the case in which O'Brien stands to gain $2.7 million to $3 million from the university.

Having lost its final appeal, Ohio State will pay former coach Jim O'Brien almost $3 million for wrongfully firing him. The Ohio Supreme Court on Wednesday declined to hear Ohio State's appeal of the coach's lawsuit against the university.
O'Brien, the men's basketball coach at Ohio State from 1998 until 2004, was fired after he told then-athletic director Andy Geiger that he had given a $6,000 loan to a prospective recruit.
Such loans are a violation of NCAA rules. O'Brien sued the university for wrongfully firing him and won $2.2 million plus interest in the Ohio Court of Claims in 2006.

COLUMBUS ? Ohio State soon will write a seven-figure check to former coach Jim O'Brien. The Ohio Supreme Court on Wednesday declined to hear Ohio State's appeal of the fired coach's lawsuit against the university, signaling an end to a lengthy court battle.

"With this ruling, the university has exhausted all of its available appeals and the case will conclude," Ohio State spokesman Jim Lynch said in a statement. "The outcome of this case is disappointing news."

Rob Oller commentary: Trust me, there's plenty 'not' to write about here

This column is not about Jim O'Brien, who once slipped $6,000 to an Ohio State recruit. It is not about the former OSU men's basketball coach, who didn't come clean about the $6,000 until it was about to go public, five years later.
It is not about the Obie who says he gave the $6,000 to Yugoslav recruit Aleksandar Radojevic in 1999 for humanitarian reasons.
And it most definitely is not about the O'Brien who won his lawsuit against Ohio State in the gray areas, which turned his former employer scarlet.
