The long, often-bitter feud between Ohio State and former men's basketball coach Jim O'Brien ended yesterday. The Ohio Supreme Court upheld a $2.46 million award to O'Brien, who sued the school after he was fired in 2004 for giving $6,000 to the family of a former Serbian recruit six years earlier.
In a 5-2 ruling, justices declined to accept an appeal of lower court rulings filed by the university.
O'Brien said the ruling provided vindication.
"I'm thrilled with the outcome," he said in a phone interview with The Dispatch. "I have felt all along that I have been treated unfairly, quite frankly. We've had two decisions by the NCAA, and we won both of those on both appeals we had to go through. There's been three levels at the court system, and we've been successful at every level.

Probably not, it all comes down to the specific wording of the coaches contract. I would not expect them to have the same exact contract provisions unless (of course) they happened to have the same agent/lawyer. Each case would be different and stand on it's own merits, etc.

Sampson has already been sited by NCAA for 5 major rules violations. I'm sure that would be cause for dismissal (depending on contract)

O'brien won the case because it was determined that the violations were only minor, and his contract said he could be fired if committed major violations.

I don't believe that statement about O'Brien's case is accurate. He won his original lawsuit before the NCAA rescinded some of his violations (on the technicality that their letter to tOSU was received barely more that 1 year fter notification). My understanding is that he won the lawsuit since he was terminated before the violations were reported by the NCAA, not due to there being no 'major' violations.

Indiana has different language regarding termination in Sampson's contract. It has been discussed in the Sampson thread.

OSU cuts check for former men's basketball coach

COLUMBUS ? Ohio State paid former men's basketball coach Jim O'Brien $2.74 million to finally close the books for improperly firing him for violating NCAA rules.
O'Brien's Columbus attorney, Joseph Murray, on Thursday confirmed the payment of $2,742,521.27.

Don't blame O'Brien for cashing OSU check

Jim O'Brien is richer today, and it's not his fault.
There are some things, of course, for which he can be blamed. The former Ohio State men's basketball coach provided money to a Serbian recruit, which is clearly against the rules, no matter how morally right it might be. He ran a program that the NCAA found to be just one step short of completely out of control.
But he didn't fire himself. When then-Athletic Director Andy Geiger performed that task in 2004, he broke the provision of O'Brien's contract that said he couldn't be fired in such an instance unless an NCAA investigation found him guilty.
The NCAA investigation later did find him at fault, but not before he was fired. So, this week, Ohio State cut O'Brien a check for $2.74 million after appeals to the Ohio Supreme Court.
