This is the end all. First tobacco - of course it's the tobacco companies fault that people chose to smoke cigarettes, when emblazoned on the side of every package is the legal equivalent of "if you smoke these, you will die". At my old job, I worked on securitizing tobacco settlement receipts for states (of course, the politicians wanted to bring all of the money forward so they can piss it away immediately), and the lawsuit is amazing - the tobacco companies have to pay the states roughly $10 billion per year - FOREVER. No, not once - a never ending stream of cashflows adjusted by inflation and production. The funny thing now is for the states not to default on the bonds - THEY NEED PEOPLE TO CONTINUE TO SMOKE. Unbelievable.

Next - in their infinite wisdom, the trial lawyers turned their attention to the gun companies, as everyone knows it is the guns fault that it picked itself up and discharged itself at a human being. Sadly, when the lawyers found that the gun companies really didn't make any money to steal, for some reason that I just cant figure out, they then decided that the gun companies weren't really culpable anymore. Those bastions of society. I guess today your degree of guilt is directly proportional to the amount lawyers can steal from you.

Now McDonald's. This may be the best one yet. I thought this suit was mercifully thrown out a year ago, but it looks like there are still fat idiots trying to make money off of their own gluttony. There is no secret that eating caloric food in excess makes you fat. If you are so stupid that McDonald's "tricked" you into buying it - then I see the result as normal evolution and hopefully you will die before your stupid genes get a chance to reproduce and water down the human selection pool. If it is your kids - then guess what - it just may be time to be a parent and make sure your kids are eating right. I swear, I wish McDonald's filed a countersuit against these idiots on basis of frivolously trying to damage a brand.

In all seriousness, I believe that the cause for issues like this is the most serious moral problem that this country faces. From tobacco to eating to driving to social security to welfare - it is this - it seems that almost no one is responsible for themselves or their own actions anymore. I really can't believe that so many are willing to delegate the welfare and direction of their lives to complete strangers, but thats the flavor of the day. There is so much more I can say on this, I don't think I could finish writing in a day, but I think the astute reader can fill in most of the blanks themselves.

I'm going to file a suit against the NCAA and my school because I had to weigh 300 lbs to play football effectively. Now I can't lose the weight and am too fat. That sounds like as good of a reason as the others. Think I have a case? :p

The comparison to smoking is pretty ridiculous. The tobacco companies KNEW that cigarrettes were killers in the 60-70s and kept that information private. They deserve to pay. I agree that anybody who starts smoking now is an idiot and deserves whatever they get.

Wow - really? I guess that sentence "Cigarettes are hazardous to your health" emblazoned on every fucking package since 1967 is indicative of the hush hush, flashlight and trench coat, cloak and dagger secrecy that the tobacco companies exhibited in the 60's and 70's.

If you want to argue from the 50s, you may have a case, but I dont think the full effects were understood by anyone at that time.

While personal responsibility is an after thought so is the idea of a legal system with some control.

I have always stated that if a lawyer that loses one of these cases they should be disbarred.

I beleive the alleged "smoking gun" in this case... was that they knew they were addictive and kept the information private.

Yes, I am, for the moment anyway, until I convince some pro rugby team to sign me. The cases shouldn't be brought and ought to be slapped down early by the courts with sanctions against the plaintiffs and lawyers who bring them.

I'm waiting for fat people to sue the government for waiting so long to tell them that sitting around on their asses all damn day long and getting no excercise is more dangerous than fattening food and tobacco put together. :wink2:

There is no use sueing the government, there is no money.
That is why they always go after private industry with cash fat companies.

I imagine the local diner sells much more harmful food than McD's but they do not have the deep pockets and this is the way the trial lawyers think.

I also believe you cigar smokers are more likely to get tongue and mouth cancer. Just a thought.
