WR Albert Dukes (official thread)

"Lewd and lascivious battery" is one of the two charges filed against Debra LaFave, the Florida schoolteacher, earlier this year (the other being "lewd and lascivicious exhibition). And that was for having sex with a 14-year-old boy...so it does appear to be Florida's statutory rape charge.

Having said that, these are only charges, and as others have pointed out, Dukes has been convicted of nothing.

Like the Troy Smith story, it is foolish to first speculate and then judge and condemn people based on facts that no one knows.

The top charge is what they will charge a MINOR with for having sex with another MINOR. He was under 18 and so was she.

The only thing that will drill him is if she was under Florida's age of consent. Regardless if Dukes is otherwise techincally a minor, he was still of consent age while she wasn't. If the age of consent is 16 (which it is in many states), and a boy has sex on his 16th birthday with his girlfriend who is only a few days younger, it's still technically statutory rape, although both are minors.

Guess Dukes wasn't a "tressel-type recruit." Or maybe he was and we need to re-evaluate what a "tressel-type recruit" is.

2 out of 3, the classroom part is much, much improved under Tress.

If Albert Dukes had sex with a minor... that's his problem. Did Tressel put the condom on Dukes' penis? Holy shit, some people forgot to take their anti-depressants this month...

Hell, no one even knows when this act occured, let alone what the ACTUAL allegations are (technically "fooling around" and having sex are the same when it comes to statutory rape laws)...

He is charged with Lewd or lascivious battery, which is defined as:

Florida Statutes 800.04

(4) LEWD OR LASCIVIOUS BATTERY.--A person who:

(a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age.

This is a Felony of the Second Degree, punishable as follows:

Florida Statutes 755.082

(c) For a felony of the second degree, by a term of imprisonment not exceeding 15 years.

There are probably sentencing guidelines which inform the court where in the range of 0-15 years any particular offense should fall. I'm not going to look it up.

I think this is the definition of "sexual activity":

794.05 Unlawful sexual activity with certain minors. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose.

This is a pretty daggone serious charge.

Its just some stupid caveat to protect doctors, emergency personnel, nurses etc... seems obvious.. but whatever.

Well, that's right AKAK, it does seem obvious, but if it's not stated, some over-zealous prosecutor will try to prosecute a doctor.


Here's a good job- There's probably a Lobbyist who works for the Florida Medical Association (Or some such thing) who's whole job it is to write legislators in Florida to make sure little lines like that get included...

Perception is reality

Though Tressel and the program are not at fault here.The perception to all the nation is that this program is an OUTLAW program. Living here
in Illinois, after the 2202 NC many ppl congratulated me for having a coach who ran a clean program and a team that played with heart and class. Now all they talk about is MC and the choker himself,RR. They think we are dirty on and off the field. We know this is untrue., but there is almost no defense for a program that makes headlines everyday. Of all the bowl teams we are the only one missing a starting QB due to improper bennies and a WR charged with a sexual crime. These two facts cannot be disputed. What should Tressell do to improve the negative perceptioN?

We're not the only bowl team missing players...scUM has a DL charged with a sex crime - not to mention the OL that pissed all over the bar in Wisc. - and OK St just had their top CB suspended from the Alamo Bowl. And I imagine there are more that I am unaware of.
