Fostoria man convicted in OSU ticket scam

A jury convicted a Fostoria, Ohio, man yesterday of theft and fraud for failing to deliver Ohio State-Michigan football tickets that he sold in an online auction.
Mark West, 54, testified in Bowling Green that he priced the tickets too low and did not have enough money to buy tickets to fulfill his orders.
West had pleaded not guilty to the charges and could be sentenced to six to 18 months in prison and fined $5,000 on each charge. Sentencing was set for Dec. 1 in Wood County Common Pleas Court.
West, the only witness called by the defense, said what he was doing was allowed on the online auction site eBay Inc. as long as the seller acknowledges a specific date when the tickets will be available. "It?s what they call a pre-sale," West said.
West said he couldn?t deliver tickets to about 250 of the 400 customers who bought tickets. In many cases, buyers paid up to $300 or more per ticket to the game. At least 200 people filed complaints against him, and eBay reported customer losses of $260,000.
