I was at a bar with a friend and two guys whom I've never met before. Near closing time some pudgy guy started getting rowdy and was escorted out of the bar with the help of his friends restraining him.
When this happened I was right oustide the bar at a pizza stand getting pizza and I saw the same pudgy guy being totally drunk and pushing people even once he was outside the bar. One of the guys I was with works at the bar but he wasn't working that night, and he supposedly had almost gotten into it with the drunk pudgy guy, which had led to him being escorted out of the bar.
My friend's buddy who works at this bar has had run-ins with the law, and rather than leaving he decided to wait until the pudgy guy and his group had left so there wouldn't be any trouble.
After I had my pizza I continued to wait for them outside the bar. While I was waiting the pudgy guy and his group walked right by me. One of the guys (who also was drunk) asked me "are you selling something #$@$@(female genetaila)." I replied "No i'm not selling anything jackass." Instantly the pudgy guy turns around and walks up to me and pushes me with two hands and says "that was my friend mother fu##@#". I regain my balance after stumbling backwards and he walks up to me again and before he raises his arm I punched him in the face.
Immediately I turn and run because I hear one of his buddies yell "lets get him". So I run but I either slipped or was tripped but I got up and continued running. I saw a cop about three seconds later with no lights on and I flagged him down to help me.
The cop immediately cuffs me and says that all he saw was me hitting the guy and he never saw the guy push me. After about ten or twenty minutes of talking to people the cop let me go. I don't think I was arrested because he never read my rights but he gave me a ticket for battery and I have a court date.
Here is what I've been thinking about as far as my situation:
Supposedly the bar has cameras inside. Can I not use the footage of this guy getting kicked out of the bar to show that this guy was out of control?
I have a witness that saw the guy being unruly outside the bar pushing people but I don't think the cops talked to him. Can I use him as a witness?
Since there were four of them and one of me does anyone really think I would be the one starting the fight while the other three guys just sit there watching?
One guy who I talked to said that the guy I hit took off running when the cops came and his friends had to call him on his cell and convince him to come back and talk to the police. Wouldn't this be contextual evidence that this guy started the altercation???
I waved the officer down and told him exactly what happened from the begining. I have never been introuble before. The guy pushed me first and came up to either strike me or push me again with four friends and me being all alone. Is that not self defense? What should I do?
