Normally that's the way it works, unless a juvenile is involved, OR the incident is classified as a domestic battery. In a domestic battery the officer "will" determine who the primary aggressor is, and take that person to jail, regardless of the victim's intent to prosecute or cooperate.

I can't see shit on that video. Good grief. I've been having heart attacks over THAT. I still don't know what did or did not happen, but if I'm Carlos, I'm spinning that as nothing - and it may be nothing!

I'm not even sure he should get any time for that.

It's certainly not as bad as the media let it on to be. The bigger question is how Urban will handle this? He just went through a grilling about discipline and the media is unfairly attributing Hernandez character issues on him from his Florida coaching days. He may feel compelled to dole out some form of punishment to keep the media off his back.
