DE Will Smith (National Champion, Super Bowl Champion, Pro-bowler; R.I.P.)

there is a surveillance video making the rounds that is being reported as the alleged hit and run that took place before the shooting.

it looks like the same type of Mercedes SUV that Smith was driving.

IF there was contact, it was extremely minor. probably didn't even trade any paint.
the red Hummer pulls to the side, the SUV goes around it, and the Red Hummer immediately follows it out of the camera's view.

the shooting supposedly happened shortly afterwards.


A. you can't really tell if there was even contact.
B. even if there was any contact, it was very minor and worth nothing more than maybe an argument at most.

To someone who played in the NFL and obviously is well off, maybe.
To a person who hasn't played in the NFL and got money when a retired police officer (allegedly) killed your father - I can see more than an argument coming about that....
If the first incident involved Smith's vehicle, it really makes you wonder what the heck was going on. None of that would excuse the behavior at the end, but nonetheless leaves you scratching your head.

I fit the description of neither one of these guys.
and I've been on the receiving end of a minor hit and run.

believe it or not, I didn't shoot anybody over it.

in fact as either driver, passenger, or regular schmuck in the area of vehicles I've been in or witnessed several accidents (all minor). Only gun I ever saw at the scenes was in the responding officer's holster.

New Orleans new just reported both vehicles had fully loaded guns in them.

doesn't change my opinion of the case, but does change quite a bit from a legal standpoint.

Detectives found a fully-loaded 9 mm handgun inside the Mercedes Smith was driving when he was rear-ended by Cardell Hayes' Hummer Saturday evening, which police say resulted in the deadly altercation.
Detectives also found a fully-loaded revolver inside Hayes' vehicle, according to a statement from New Orleans police.

If I lived in New Orleans I would carry a gun, if I were African American in New Orleans I'd carry a very efficient gun. The fact ( seemingly) the revolver wasn't pulled shows smith had no intention to use it and didn't realized psycho was going psycho. Sounds like
-some insignificant altercation
-followed by road rage
-followed by accident
-followed by more road rage
-followed by another excessive and unnecessary killing

Looking at the surveillance video, one has to ask the question, why did the driver of the hummer stop in the first place? Not that it probably matters from a legal standpoint, because there's the whole "assured clear distance" thing, BUT where this occurred was not an intersection, and there was nobody crossing the street. The Hummer just stops -- almost as if he was trying to initiate the contact. It seems to me there's still more to this story that hasn't come out yet.

No idea, but there is a man wheeling two 64 gallon trash bins to the curb in the video. Hayes could claim he stopped because he saw that man approaching the street. Perhaps there was a vehicle ahead of him that was pulling into the curb-side parking space that we can't see in the angle of the first part in the video. Really not sure that matters. Smith was following too close, rear ended him, then fled the scene. Hayes appears to follow for three blocks and then rear ends Smith either on accident or in retaliation, at which point both get out of their vehicles and exchange words. Witnesses reported Smith said something to the effect of, "Get out of here or I'll get my gun." Hayes responds, "Fuck y'all, I got one too," and opens fire as Smith is climbing back into his vehicle, presumably to retrieve his 9mm which is in the passenger cabin.

At least, that's my interpretation based on what's been reported thus far.

This will be a test of Louisiana's Stand-Your-Ground law.

I think you misread that report. The revolver also belonged to Hayes and was recovered from his H2. Smith had a 9mm in his vehicle and was ostensibly climbing into his Mercedes to retrieve it, which is why Hayes made the decision to draw his .45 and shoot Smith in the back.

I personally have my doubts about this one based purely off everything I have ever heard or read about Smith.
Literally never heard anything negative about Smith's personality and character since he was drafted by the Saints.

the "coincidence" that Smith was eating with a guy involved in the death of Hayes father muddies the water even more.

Been thinking the same. It's almost as though he was looking for trouble. If that's the case, the next question is if he knew who was behind him when he went looking for trouble. Not a far reach given the connections...
